Tax: Limited Relief for 403(b) Plan Reporting |
Effective Jan. 1, 2009, ERISA Code Section 403(b) plans must file complete Form 5500 annual reports. Many 403(b) plans use individual participant-owned annuity and custodial contracts for funding and employers are concerned about their ability to track down information on contracts to which employees are no longer contributing. The Department of Labor has granted limited relief to employers. With respect to contracts issued before 2009 that are no longer eligible contracts under the plan, the employer (if unable to obtain information on the contract) does not need to report that contract on its Form 5500.
